WARRANTY CLAIMS – WHOLESALE CUSTOMERS

  1. All products offered in the store have a seller's warranty valid in the Republic of Poland.

  2. The warranty period for products is 12 months and is counted from the day the product is delivered to the customer.

  3. The document entitling to warranty protection is the purchase proof: VAT invoice.

  4. Notifications of product defects and submission of the appropriate request can be made via email at: rma@hurtel.com, or in writing at: ul. Kostrzyńska 11, 65-127 Zielona Góra.

  5. In the above message in written or electronic form, please provide as much information and circumstances regarding the subject of the complaint, especially the type and date of the irregularity and contact details. The provided information will greatly facilitate and speed up the consideration of the complaint by the seller.

  6. To assess physical defects of the product, it must be delivered to: ul. Kostrzyńska 11, 65-127 Zielona Góra.

  7. The seller will respond to the customer's request immediately, no later than within 14 days.

You are obliged to deliver the faulty item at your own expense to: Hurtel Sp. z o.o., ul. Kostrzyńska 11, 65-127 Zielona Góra (please do not send packages with cash on delivery), and if delivering the item by you would be excessively difficult (e.g., due to the type of item or the way it is installed), you are obliged to make the item available to us at the location where it is.

Responsibility for legal defects is essentially the same, and the time for reporting starts from the moment of learning about the defect, and the limitation periods from the finalization of the ruling in the case of the item affected by the legal defect.

INFORMATION ON EXERCISING THE RIGHT OF WITHDRAWAL – APPLIES ONLY TO RETAIL CUSTOMERS

 

According to current legal regulations, you have the right to withdraw from this contract within 14 days without giving any reason.

To exercise the right of withdrawal, you must inform us (Hurtel Sp. z o.o., ul. Kostrzyńska 11, 65-127 Zielona Góra) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax, or email).

You can use the withdrawal form template, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

In the event of withdrawal from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of delivery method other than the cheapest standard delivery method offered by us), immediately, and in any event not later than 14 days from the day on which we are informed about your decision to exercise the right of withdrawal from this contract. We will carry out such refund using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such refund.

We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

Please send or hand over the goods to us immediately, and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

INFORMATION ON THE DECLARATION OF EXERCISING WARRANTY BY THE CONSUMER (COMPLAINTS) – APPLIES ONLY TO RETAIL CUSTOMERS

 

In accordance with applicable regulations, we bear responsibility towards you under the principles defined in the Civil Code for physical and legal defects.

After detecting a defect, you have the right to:

a. submit a statement demanding a price reduction;

b. submit a statement on withdrawal from the contract, but not when the defect is insignificant;

c. demand a replacement of the item free from defects;

d. demand the removal of the defect.

 

We will respond to your statement or request within 14 days.

You are obliged to deliver the faulty item at our expense to: Hurtel Sp. z o.o., ul. Kostrzyńska 11, 65-127 Zielona Góra (after a positive consideration of the complaint, we will refund the cost of the cheapest registered shipment - please do not send packages with cash on delivery), and if delivering the item by you would be excessively difficult (e.g., due to the type of item or the way it is installed), you are obliged to make the item available to us at the location where it is.

We bear the costs of replacement or repair except if the faulty item has been installed. Then you are obliged to bear part of the costs exceeding the price of the item. Alternatively, you have the right to demand from us the payment of part of the costs of dismantling and reinstallation, but up to the price of the sold item.

We are responsible under the warranty if a physical defect is found before two years from the moment the item was issued to you, and if the object of sale was a used item - within a year from the moment it was issued. Your right is time-limited to a year from the day the defect is detected, but it does not expire earlier than two years from the moment the item is issued, and if the object of sale was a used item - before the expiration of a year from the moment the item was issued. An exception is when the period of usability of the item specified by us or the manufacturer ends after two years from the moment the item is issued. We are then responsible under the warranty for physical defects of this item found before the expiration of this period.
